MEDIATED SETTLEMENT AGREEMENT
This Agreement is made and entered into as of [DATE] by and between Party A and Party B (each a “Party” and together the “Parties”), following a voluntary mediation facilitated by Elerion.
1. Recitals
The Parties have a dispute concerning [SUBJECT OF DISPUTE]. The Parties wish to resolve their differences fully and finally, without admission of fault or liability by either Party, and have participated in a voluntary, confidential mediation. Each Party enters into this Agreement freely and of their own accord. This Agreement records only the terms both Parties formally accepted during the mediation.
2. Payment
Party A shall pay to Party B the sum of $[AMOUNT] on or before [DATE], by [METHOD]. Upon receipt of payment in full, this obligation shall be deemed satisfied.
3. Shared Parenting Schedule
The Parties agree to share time with their child(ren) as follows: the child(ren) shall reside with Party A on [DAYS] and with Party B on [DAYS], with holidays alternating each year. Exchanges shall take place at [LOCATION]. Each Party shall keep the other reasonably informed of the child(ren)’s health, schooling, and welfare.
4. Mutual Release
Except for the obligations created by this Agreement, each Party releases and forever discharges the other from any and all claims, demands, and causes of action arising out of or relating to the matters described in the Recitals, whether known or unknown, up to the date of this Agreement.
5. Confidentiality
The Parties agree to keep the terms of this Agreement, and the substance of the mediation that produced it, confidential, and shall not disclose them to any third party except as required by law, to their respective legal or financial advisors, or as necessary to enforce this Agreement.
6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of [REDACTED], without regard to its conflict-of-laws principles.
7. Entire Agreement
This Agreement constitutes the entire understanding between the Parties regarding its subject matter and supersedes all prior discussions. It may be amended only by a writing signed by both Parties. If any provision is found unenforceable, the remaining provisions shall continue in full force and effect.
The Parties, having read and understood this Agreement, sign below and intend to be bound by its terms.
